CONTRACT FOR PURCHASE
I, Tracy Paskero, principal of J Bar T Ranch, the breeder/owner of the said puppy (described below),
hereafter "Breeder", do enter into an agreement for the purchase and sale of a puppy with
_______________________________ hereafter "Buyer", for the purpose of transferring ownership on the
said puppy. The said puppy is a purebred Miniature / Toy Australian Shepherd, male / female, sired by:
____________________________________ out of ______________________________________.
The puppy is _____________________ in color, with _______________________ markings. The said
puppy's date of birth is ___________________________________. The Breeder will transfer
ownership of the said puppy for $_______________ to be paid in full. If the amount given is a deposit or
down payment, the sum of $__________ was received and the amount of $______________ is due and
payable on or before the ______________________.
Should a deposit be paid, and the puppy it was paid for, becomes unsaleable for any reason, that deposit
shall be applied to any other available puppy that the depositor chooses, provided that puppy is healthy and
not spoken for.
Buyer is responsible for paying for shipping or delivery costs of puppy.
Breeder is to furnish vet health certificate should airline shipping be used.
Registration papers with the National Stock Dog Registry and/or American Stock Dog Registry are / are not
included as part of this agreement, and will / will not be provided to the buyer upon full payment of the DOG.
Breeding rights are / are not included with the purchase on this puppy.
Breeder guarantees that the DOG is healthy and free of known contagious diseases and has had
vaccination(s) and worming required for its age at the time of this agreement.
The buyer agrees to have the DOG examined by a licensed veterinarian within three (3) working days of
receipt of the puppy. IF the DOG is determined to be in poor health, as evidenced by a veterinarian's written
statement, the Buyer can elect to keep the DOG, assuming all costs for its care, or may return the DOG for a
full refund (less shipping costs) upon the Breeder's receipt of the veterinarian's statement regarding the
DOG'S health. This provision will expire 72 hours after Buyer takes possession of the DOG, except
that Breeder will accept return of DOG up to 12 months after purchase if DOG has a congenital defect within
that time as certified to by a licensed veterinarian. Thereafter, Buyer assumes all risk concerning the health
of the DOG.
Buyer certifies, by signing this agreement, that the DOG will live with the Buyer, be confined in a secure,
fenced yard, will have adequate exercise, nutritious food and necessary health care by a licensed
veterinarian, including all puppy vaccinations, and thereafter, yearly vaccinations including rabies.
Buyer also certifies, by signing this agreement that he/she is not acting as an agent in this purchase; that the
Buyer will not resell this puppy to a pet store, guard dog business or medical research facility.
Breeder makes no guarantee regarding the loss of the DOG because of accidental death, theft, sickness,
etc., or any other loss beyond the Breeder's control, except as stated above.
If the DOG is being sold as Pet Quality which is defined as a puppy that is not guaranteed to show in
conformation classes and is not for breeding purposes. The DOG should be spayed/ neutered no later
than the age of seven months unless sold with breeding rights.
The DOG is warranted only for the purpose of being a companion animal and while it may be capable of
performing other functions, no warranty is given as to its fitness for any special purpose.
This Sales Contract is non-transferable.
Should Buyer decide to sell the dog at any time, Buyer agrees to first contact Breeder and allow the Breeder
the first opportunity to purchase the dog for original selling price or less; Breeder shall have 10 days to
deliver re-purchase price to Buyer.
Should Buyer relinquish ownership of said DOG, back to Breeder, this Sales Contract shall be deemed null
and void.
Although there are no plans at present to stop breeding Miniature Australian Shepherds, the above
guarantees are valid only so long as Breeder is breeding said dogs. Should Breeder cease breeding said
dogs, for any reason, this Sales Contract will become null and void. In the event of a dispute, Collin County in
Texas will have jurisdiction over the matter.
In the event Buyer fails to abide by the terms of this agreement and enforcement becomes necessary it is
agreed that Buyer will, in addition to amounts determined to be due hereunder and interest thereon at the
highest legal rate, be liable to Breeder for attorneys fees, costs of court and all expenses attendant to
enforcement of this agreement.
This agreement constitutes the entire agreement reached between the parties; no agreement, promise or
inducement has been made or entered into that is not set forth herein in writing. This agreement cannot be
changed, altered or modified except by writing signed by all parties to this agreement.
